SCOTTSBLU Questions on spot zoning land outside the city were raised by the Scottsbluff Planning Commission Wednesday and a public hearing on a request to rezone land west of Scottsbluff was continued to the next regular meeting The commission members also re elected Ted Cannon chairman and Max Coppom vice chairman of the commission Cannon was not present The public hearing was held on a request of Daniel Ramsey to include a tract of land about a half mile west of Scottsbluff around the Winters Creek Canal in the city zoning jurisdiction and to zone part of the land la and the rest agricultural The commission favored including the land in the zoning jurisdiction but did not approve the request because of the rezoning question Member Howard Olson suggested that zoning a tract of land la in the middle of nowhere might be considered spot zoning which is forbidden by state statute Coppom presiding in the absence of Cannon felt no concern about the spot zoning question because the request involved a large amount of land The city staff will investigate the matter in time for the next regular meeting of the Planning Commission Nov 2 The commission also continued a public hearing on a request of red and Pauline Nicodemus for approval of a preliminary plat in the Tracts area because the new plat submitted was significantly different than the original The commission voted to approve an application of Larry Myers to rezone four lots in Westfield Estates from la Myers wanted the change because the lots are adjacent to the Beltline Highway being considered as the loca tion for the Nebraska Highway 71 bypass and the lots would be un desirable for residential purposes An application for a preliminary plat of Charles Davey Jr was withdrawn because of a change in the plans The commission held a public hearing on the request for the preliminary plat in the Burbach Subdivision which is south of 42nd Street and would create 20th Avenue Since both tracts in the subdivision were affected by the change the application has to be refiled and new consideration and public hearing dates will be set The commission also put off a decision on a request from Otis Terhune for a preliminary plat in the Terhune Subdivision which is south of West Overland and west of Avenue I The matter was tabled because of the unusual nature of the plat which would have located an alley right through the Dairy Queen building A public hearing was set for Nov 2 on a request of Lawrence Baltes for a preliminary plat in the Baltes Addition just north of 27th Street west of Avenue I The change includes the addition of a 17 foot dedication on the south edge of the property for public purposes such as like street widening sidewalk or utilities and calls for 50 foot lots from the second lot west of Avenue I to Avenue inally a public hearing was set tor Nov 2 on an application of the city for a subdivision on the west side of Ninth Avenue north of the Beltline Highway for a storm sewer
